General Conditions These Terms of Service apply to all sales and transactions between Tiaki and our customers. Unless explicitly agreed upon in writing, these terms are acknowledged and accepted without reservation by all parties.
Offers and Orders All verbal and written offers and orders must be confirmed by Tiaki either in writing or by the dispatch of goods and an invoice to be binding. Our offers are without obligation unless specified otherwise, with each agreement applicable only to present and future sales, not past transactions.
Delivery Terms, unless specified otherwise, are for informational purposes only and non-binding. Delivery delays do not entitle cancellation of orders or claims for damages. We may perform partial deliveries, which are treated as separate contracts.
Pricing Prices are based on the cost factors at the time of contract conclusion, such as raw materials, taxes, carriage, and insurance. Price adjustments due to cost increases will be borne by the buyer. Failure to accept delivery within the agreed timeframe allows us to revise our prices.
Acceptance and Risk Goods are delivered from and accepted at our warehouse in E 101, Hari Srushti, Indira Nagar, Nashik 422009, India, sold as is where is, with all risks transferring to the buyer post-delivery regardless of delivery terms. Returnable packaging material charged to the buyer will be reimbursed if returned undamaged within three months.
Product Guarantees and Liability Goods are sold “as is” and the acceptance is final seven days post-delivery. Complaints must be made in writing within this period, and no claims related to the quality, such as colour or slight variations, will be entertained for goods sold as seconds. Our liability for faulty goods is limited to replacement or refund, not exceeding the invoice value.
Returns Returns are not accepted without prior written consent from Tiaki and must be returned as per our instructions at the customer’s risk and expense. Goods with minor damages are not eligible for return.
Payments Payments are due within 30 days of invoicing, with all payments to be made in the currency stated on the invoice. Late payments accrue interest at an annual rate of 12%. Non-payment may result in immediate claimability of all outstanding amounts and suspension of further deliveries.
Retention of Title Title to the goods remains with Tiaki until full payment is received. We reserve the right to retrieve goods in case of non-payment, with all risks associated with the goods borne by the buyer from delivery.
Contract Cancellation Failure to meet any obligations may result in contract cancellation without notice, subject to our rights for damages. Cancellation accepted by Tiaki entails a 20% indemnity of the order value.
Dispute Resolution All disputes shall be resolved in the courts of Victoria, Australia, and governed by Australian law. Only the English version of these terms is legally binding.
Amendments Tiaki reserves the right to amend these terms without prior notice. Continued use of our services following any changes constitutes acceptance of the new terms.
